Temporary restraining order stays, case moves to federal court

Judge Randolph Bartlett allowed todays hearing to move forward, despite Justin Pierce of Jackson Lewis, the attorney for the town of Quartzsite asking the temporary restraining order to be thrown out, claiming that  employee versus employer agreements cannot be intervened in in such a manner. After about 20 or so minutes of riveting testimony by Sgt Will Ponce, the attorney for the town asked to approach the bench. Judge Barltett announced that they were excercising their right to move the case to federal court. He ordered that the papers be submitted in ten days and that the temporary restraiing order will remain in place.

No cameras or other recording devices were alowed, so if you want the transcript, you'll have to pay La Paz County for the CD.

  2. That doesn't make sense to me. If you eliminate the demand, there goes the supply. But what do I know? I'm as dumb as they come when it comes to trying to figure out people! When YOU figure it out, will you let us know?

  3. Unless the town's attorney, who interestingly enough works for the same law firm that wrote the whitewash report of Chief Gilbert's impropriety, is claiming they can't get a fair trial in the La Paz County Court, I don't understand the need for a change of jurisdiction. Even at that, why not just move it to another county?

At this point in the proceedings, I don't see what jurisdiction the Federal Court has unless it has been determined that this is Whistleblower case, protected under Federal law, or a civil rights/due process issue. In that case, it would seem that it should have been the QPOA's attorney who would have asked to move this to the Federal courts.

  5. There are several federal allegations. This could go really good for the QPD Officers and the town. There are a couple of people behind the scenes her. Lowery and PPD Chf. Mendoza. Mendoza has his fingers in everything shady in this county.

  6. Do we have any facts that the Town of Quartzsite has reinstated or rehired any of the Quartzsite 10 as the TRO has ordered?
