Stuck with Police Chief Jeff Gilbert another year?

Well, I hate to disappoint all those Ogre-on believers but campaign promises of getting rid of the police chief, followed by a post swearing in "just trust me" is going to go down tomorrow like this:

Someone makes a motion to not renew El Jeffy's contract, someone seconds, virtually no discussion ensues because they already decided in last week's executive session, and they all vote to turn their back on Jesus, I mean Jeff, I mean, well both, or one and the same depending on whether or not you've lost all faith or you're one of the donut disciples from "Coffee with the Nazi".

But how much you want to bet they all downplay the part about how the last incarnation of the clown council gave Chief Dilbert a rolling clause in his contract that guarantees him another year. We're stuck with the source of our lawsuits into 2014, or until AZPOST de-certifies him, or he's indicted for abusing the NCIC, or a bolt of lightning strikes him down...

That's right children, there's no happy ending to this bed time story. So the Ogre-on's promise that the neo cabal could trade donkey for the evil Queen Taftalex last summer, then choose not to renew donkey's contract and Far Far Away could live happily ever after was just a fairy tale.

  1. Actually, Pam W. saw this coming months ago. She seems to be the only person who actually reads the rules. (And she doesn't even live in Quartzsite!)

    Having said that, I wonder if this the time for the nuclear option? There's an A.R.S. that says that when the council meets illegally (illegally constituted?), any business it conducts is null and void and has to be re-visited. (I can't remember the number of the statute. I've posted about it before. Is it S 38-431.05?) Maybe this is the time to declare that Gilbert's contract was ratified under false pretenses, when the usurpers were illegally voting?

    "The TOWN agrees to employ said OFFICER as Police Chief, a full time position for a rolling three (3) year term which shall commence on February 8, 2011 and shall end on February 8, 2014.

    It is anticipated that this contract shall be extended each year so that, at any time, the Term shall be for three (3) years.

    If this contract is not so extended, the Council shall notify the OFFICER in writing before February 8 of each year and the OFFICER shall be entitled to receive as compensation the amount the OFFICER received during the prior year for the remaining two years of the Term; otherwise it shall be deemed that the Council has extended the normal expiration date of the Term for one year (to equal the rolling three (3) year rolling term) with the same salary and benefits, plus any increments authorized by the Town Manager and approved by the Council."

    (on page 2, Section C). If he was not informed by the Town on or before February 8, 2012 that his services were not needed (that they didn't want to roll with him), his contract automatically extended by another year, to February 8, 2015. If he is dismissed WITHOUT CAUSE before its "rolling" period ends (on February 8, 2015, a "rolling" three years), the contract provides that he gets a year of severance (between $80K & $90K). The then Vice-Mayor, Barbara Cowell, signed the contract (which became effective as of February 8, 2011), not Mayor Foster.

    1. Yes, it appears we are stuck with him until 2015, or until an act of God, or grand jury. The town could, and should fire him FOR cause, but because they lost insurance through the Risk Pool, they can no longer afford to litigate to defend their position if he sues in retaliation.

  4. It's "pay me now or pay me later."

    By not firing Gilbert, the Town Council (as the Town and as individuals) just opened itself to "failure to supervise."

    If Roth's, Jones' and Gilford's lawyers are smart, they will add this count to their several civil lawsuits.

    I expect it would have been cheaper to fire Gilbert and defend his one suit than to incur failure to supervise in five suits.

    I always liked that band Queen. They had some good songs, like Get Down, Make Love. I usually text that to Garcia when my Viagra has started to work. Except I just use a code, because I'm a cop and we like codes, and I say "I got a bad case of Code 999" because that's the code for "officer requires immediate assistance." My usual window for activity after popping a little blue pill is only about 1/2 hour, sounds like an immediate assistance need to me. Amirite?

  7. Why doesnt the goverments that be stop this ? I am a teenager in this town went to school by the capt. Of evil and now im almost old enough to be allord to be heard but by who afraid to be arrestrd for thinking out loud , he knows hes a bad man and so does evrryone , oh well thats what hells for., he is goung he knows it ,
